I am currently in despute with Moben kitchens regarding the
fact that I ordered a kitchen, paid by cheque a deposit of £2,150
and then changed my mind within seven days and requested to cancel.
Without any reference to any information held within the contract
they are now declaring that they can claim twenty percent of the
total cost of the kitchen from the deposit. This I find disgusting
since no work has been undertaken.
I also find it very annoying as they are using Common Law contract
as their basis for doing business and this contract is not well
known as everyone tends to deal with Contract Law.
As soon as I cancelled I had Mobens heavy handed, "We don't
care just give us the money" legal team on the phone. Despite
repeated requests to get them to give me my money back and the
very distressed state that I was in there was very little compassion
and no effort was made to refer me to someone who could have made
the financial decision to return my money.
Moben very craftily fail to mention that if you are paying by
cheque you do not have any rights. Therefore I urge anyone considering
buying from them to take out credit, even if you were intending
to pay by cash, you can always pay off the loan using cheque once
you are happy that you intend to complete the contract.
I managed to get a letter to Mr Hill the Director who again has
taken the same attitude as the legal team. Though has agreed to
give me fifty percent of my deposit, which still means that I
would loose £1,000 and received nothing in return. Unfortunately
I am now in a position where I have to take them to the small
claims court to get back any more money.
I am unemployed and deperately trying to recover the money so
as to keep my house. Moben don't appear to be interested to them
its money money money.
My advice is to do alot more research before buying a kitchen.
So many people I have spoken to since has said "Oh no you
haven't gone to Moben have you..."
