We took out a contract with Harlequin Windows for new Double
Glazed units for our house. We choose Harlequin who were more
expensive than their competitors, as they had a good reputation.
It is now March 2002, some three years after we took out the initial
contract with Harlequin, and we are still waiting for the windows
to be finished.
We paid the final balance for the work 6 weeks after we signed
the contract.
The bases of our complaint is as follows; The units installed
are faulty. The patio doors only open 90 degrees, and limit access
to the patio. The leaded pattern does not match other installed
units. We have never been satisfied with the work to date. We
have had 13 visits from Harlequin representatives, resulting in
13 days off work costing in the region of 2255 in unpaid leave.
Each visit the representative did not have the correct units,
and could not carry out the work.
We telephone Harlequin to no avail. We have also written to Harlequin's
Sales who offered the following statement:
"Harlequin Windows Ltd being under new ownership since June
2001, I would respectively request that you accept our unreserved
apologies for your ongoing concerns and indeed our naivety with
these issues"
We have also received another response from Harlequin
"Following on from our conversation, I would like to respond
to the final paragraph within your letter dated 20th February
2002 for a claim of compensation. We like all industry do not
promote the issues of compensation and therefore after consideration
I have to state that a payment or reduction cannot be awarded
to you on this issue.
Obviously it is your prerogative, if you so desire, to seek litigation
for your grievances through any third party, however I will stress
that this action will be fervently resisted. This said I am sure
all issues can be resolved amicably and look forward to concluding
all matters for you"
Going by the quote" it is your prerogative, if you so desire,
to seek litigation for your grievances through any third party"
,provided above, Harlequin are prepared to go to court on the matter.
We would welcome consumer views on this matter.
A Right of Reply letter has also been issued to Harlequin to make
them aware of this posting and of any views that might be made by
the general consuming public.
