I bought several items from the above shop on the 24/4/02. Due
to travel, I was unable to return two faulty items, an inverter
and an insect killer until today. I explained that the goods did
not work and that this was the first opportunity I had had to
return the goods.
I was told that I would not be given a refund until the shop
or the manufacturer was able to test the goods. I was told that
the shop was not able to test the goods whilst I was there, despite
the fact this is a camping shop and both the items were designed
to run off a 12-volt system. The shop insisted I took a credit
note or a replacement.
I refused both on several grounds. One, that it is my legal right
to obtain a full refund on faulty goods, whether or not they are
able to test them on the premises. Two, that a credit note would
be no good to me as I no longer live locally. Three, that a replacement
would therefore mean I would not be able to receive a refund at
a later stage, if the replacement did not work and as my boat
is moored in Yorkshire, it would be a long way to return the items.
When I explained that legally, I was entitled to a refund and
suggested they contact the CAB, they refused. I was therefore
unable to prove my consumer rights.
I was in the shop for 40 minutes, despite the fact I explained
repeatedly that I had pets in my car and therefore did not have
much time. In fact, I had to go out to the car during this farrago
to ensure the animals were all right.
As they refused to give me a refund on these faulty items, refused
to confirm that my rights were in violation , I asked them to
state their position in writing. Eventually, they presented me
with a letter and gave me a credit note, despite my repeated explanation
that I was not able to redeem it. I accepted it at the time as
due to their constant delays, I was running extremely short on
time. I am returning the credit note tomorrow with a letter detailing
the above.
I confirmed my rights as soon as I was able to do so and understand
I am correct.
